If it said "you are bidding on not a magic card, but just a picture of one" I am pretty sure less people would get fooled.

the wording is deceptive, it sort of makes you think its a picture of the card you are seeing, not buying. IE he is not using a "stock photo" to show off the product.

The listings are considered deceptive because picture of a card could suggest that the picture in the listing is the picture of the cards that are being shipped.

Selling empty branded boxes, like an iPhone case with no phone, or a picture of an expensive item, is against eBay rules since it is often misleading to the buyer. Also, this would need to be listed under "photographs" or something of the sort, even it if were allowed. Its listed under cards.
